The man accused in the stabbing death of Dodger fan Jonathan Denver last week was released from custody tonight, according to Sheriff’s officials.

Police arrested Michael Montgomery, 21, of Lodi, in the killing of 24-year-old Los Angeles Dodger fan Jonathan Denver who was fatally stabbed after the team’s loss to the San Francisco Giants. Montgomery was arrested September 26, a day after the homicide, which San Francisco police said was sparked by a rivalry-fueled fight that broke out near AT&T Park the night before.

The confrontation began four blocks away from AT&T park, when Denver’s group bumped into the suspects’ group and rival comments were exchanged. The two groups parted after the initial exchange, but after a second fight Denver realized he has been stabbed. Montgomery’s family maintains that the stabbing was in self-defense, after he was hit with a chair.

Montgomery’s release came after District Attorney George Gascon said he wasn’t ready to file criminal charges in the case for lack of evidence. Gascon said prosecutors need to be certain they can prove a case beyond a reasonable doubt before proceedings. “It is the People’s burden to prove beyond a reasonable doubt that the defendant did not act in lawful self-defense,” Gascon said.

Authorities are asking the public to come forward if they have any eyewitness accounts as to the incident, or if they have videotape.
